Apple says that the phone is locked by TracFone

So I buy a used iPhone 5s model à1453 and bring it in to verizon (our account is with vzw) store, get a SIM card. They can't get it activated and don't know why. When I got the iPhone it was annihilated and on screen configuration (on the configuration screen, language settings) so it gets through selections of language/location/wireless and try to activate, it fails, message (could not turn on... the activation server was unavailable, try again later...) So I think the phone is defective. We put the phone in recovery mode, reinstalled the firmware via itunes, activation failed on itunes too.

Get an appt with Apple at the store and they say it is locked by TracFone. Guy from Apple shows me on his iPad where it shows locked to tracfone.  So I talked to TracFone twice and they do not have this IMEI in their database, 2 + levels of support later and still they say they don't have locked it. I even called Sprint / US Cellular/Verizon in case they like cdma carriers have locked and they do not have the locked imei. Returned in apple store today and they were kind enough to provide us with a new phone, but as soon as we tried to activate the phone, we get the same error message. Going round and round in circles. All advice is appreciated.

OK, weird. Is it possible that you used an iTunes backup to restore your data to the new device?
