  Where are the CD they are from? If the ex got custody of their then you really don't have a legal right to these songs. If on the contrary the ex in a fit of rage admitted those who are yours then took a hammer and smashed all the you need to use 3rd party software to transfer them to your music library. You don't say what period of the computer that you have. I used the two Phoneview (Mac only) and TouchCopy (Mac and PC) and both work very, very well to transfer an iDevice to computer equipment. They cost money but are good to have around situations like yours.
