OEM license is tied to the first machine that is installed on the OEM license dies when this machine dies.
An OEM license is not transferable.
And you need a legal edition of Windows, enabled for upgrade.

Yes, as long as Vista is still installed on the hard drive you can use a copy of Windows 7 upgrade to upgrade your computer but you will need to boot the computer with the Windows 7 dvd and perform a custom installation. In the circumstances, consider the 14 tryout before purchase. Think of it as a troubleshooting tool
a. If the 14 works and 13 does not work, then 13 has the problem
b. If 14 and 13 do not work, then the computer is your target for troubleshooting.
