My daughter just got an iPhone 6s with ios9.3.x and old phone is an ios7.1.2 running of iPhone 5s.  Can I restore the backup old ios on the new phone without updating the old phone? The old phone is maxed on memory and does not have the update.

    If you "set up as new" this does not erase the content currently on the iPhone. It's more a set upward for iTunes can communicate with your iPhone. It is really "set up" a return for your iPhone and iTunes connect with your phone.

    The only way to restore the health data is to backup the old phone and restore it on the new phone. You must use iTunes backup with active encryption, or backup to iCloud.

    The reason why you can't find it is the app will not work on the current version of the iOS and the developer has decided to not update. You can use it on your old unit if you still have it. Or you can look for a substitute on the iTunes Store.

    Can't say if it will be or will not be successful but you need to update the software on the new phone before you attempt a restore. You cannot restore a phone with the latest software, the phone restore you to the needs of the same software or later.
