Deceptive trade practices

Ok. I extended the warranty on my laptop in August 2009. When I bought the warranty, I wanted to just get the General warranty but the dell rep told me that it would not cover the battery and the screen. So she asked me to buy other security (all care) telling me that the warranty would cover everything. Since then, she never mentioned that the extra security did not cover the battery, I have been misled to think that the extra money I was paying cover everything, including the battery. Otherwise, I would have never bought the additional guarantee. Now its been a week my battery dies upward and I talked to the XPS technical support and they told me that I need to replace the battery and that he offered to buy a Dell. When I mentioned that I have a warranty on my laptop, I learned that my warranty does not include the battery. I told them how I ended up buying the additional guarantee that I have on my laptop, they couldn't give me an answer. For the last 3 days, I tried to get an answer on the deceptive commercial practice, they used to me, but all in vain. I spent hours on the phone for the last 3 days, but all they do is move me from one operator to another. I have explained the reason for my call to each and every person that I have spoken, but all that they transfer me or put me on a hold that goes nowhere. And almost all of the calls end up in the technical assistance service. Reference Dell there still a customer service to help clients or they don't care of customers. All I want from dell is a response from a responsible person, but given that most of the calls is outsourced to the representative of the support even seemed to care about the issue. So for 3 days, I was not able to get help on the issue. Now because they made me buy something to mislead the facts, they have violated deceptive trade practices Act.

And if someone wants to claim that I was not a responsible buyer, please read the deceptive Trade Practice Act that will tell you what dell has done for me are completely illegal.

hrova - I never mentioned battery while I extend me my warranty. The representative mentioned the battery and offered to buy the extra warranty telling me which would cover everything. Read this new -failure to disclose information about products or services known at the time of the transaction and has been used to mislead the consumer in a transaction that otherwise would not have signed the information had been disclosed. (Subsequent)

How does just you offering to pay back money be a gesture of customer service for you? Is all the money? Do you know something about the time value of money? I don't speak of cutomer service (customer service), so all I need was guaranteed a refund, I have not here to write this.

If each customer would be as well informed as you are, these companies would never deceive you and there is not these laws as a deceptive Trade Practices Act. If you mean that the existence of such a law has no reason since you believe that each client is well informed and the companies never mislead.

Finally, before answer you once again, I would ask you to go once on the deceptive trade practice Act.

  • printer misidentified after update

    Hello

    I have a client with a deskjet 712c. He said that an HP update basted firmware on his printer and is now asked to install the new drivers by the new hardware wizard. But now the printer is identified as the model 720. If it allows the update to go through the printer output is garbage.

    Reinstall it while the 712 c. Far as I can tell the fireware is not editable on these old deskjets, only the colorjets or newer have been.

    As a test, I plugged this printer on another computer with a new installation of windows xp. Again, it has been recognized as the model 720. I had to manually, choose to install the 712 c drivers, windows warned me that they weren't the right drivers and the computer may not work if I choose to use this driver.

    The printer works well on this new install, but because I don't use the HP cd install I don't have other hp installed software I have only the supplied windows driver.

    On the clients computer, it has everything.

    So I was wondering if the firmware is updateable on this 712 c, and if so, where can I download a utility to fix errors of identification.

    At this point, it seems that the customer is right that the identity of the printers is changed.

    Do not load, it's just search. With a simple work around the printer is always useful and it has ink to use both upward. I took personal interest in the question of whether the firmware on this printer can be manipulated any way and if so is it manipulated by an update or not. Maybe it's just become corrupted.

    The receivables, it is that it's unfair trade practice for a manufacturer to make an almost unusable product, but don't not to make available to the customer the means to cancel this action and for the manufacturer to enjoy or otherwise to reap the benefits of this action. I've said before, but when he uses this software hp printer warns him he could print their documents on an hp printer. Without any other evidence, he became suspicious and annoyed.

    I posted in this forum to see if anyone has had a similar experience or that he knows more about it. I realize that there are tons of other more immediate problems that need attention here if I don't get all the interesting answers it's OK, I'm looking elsewhere.

    It's disgusting.

    1. After buying a new HP ENVY 7640 and following the instructions, I tried the automatic download of the software.

    5. My ISP is Telstra, the connection is very fast.  I have no problem to download software from other sites (Apple updates are sometimes 100 MB).

    After receiving no help from the so-called "24/7 Support" of HP (which is a breach of the Trade Practices Act 1974, as amended), and no response to this "support Forum", I thought about it for me.

  • Question about credit/copyright.

    I'm not sure this is the right place to ask, but I don't know were elsewhere.

    I did a huge design in illustrator for a reason of a zoo, all in vector. The design is almost finished, but need a few finishing touches. My client now has a company that wants to buy his product with my design. The problem is that the company wants to make changes in design, using its own designers, before purchasing the final product. I'm not sure of the amount of changes they want to do, but I think that I can't take credit for the design if it changes a lot.

    I'm looking for some advice here. I've been designing for only 2 years and this is one of the biggest projects I had so far, so for me, it's a big deal to add to my portfolio and take credit for it. How other designers go with situations of this kind? Should I charge a fee to give my credit? I am, however, getting paid for the design, but I would really like to take credit for it too, after all this hard work...

    Well, the verbal agreement was I do all of the design, not only a model, they print it and sell it.

    The word of the device (and unfortunate) here is "oral". If you haven't written anything (a signed estimate that clearly defines the work being controlled) - BIG mistake - you have little to stand on. (Technically, oral contracts are binding. «(But he always comes back to WHO, if anyone, can prove what has been agreed orally).» This "customer" can simply bail out on you. But you have the advantage of having the work; and the 'customer' has no right to its use at all.

    At this point, I would like to send the 'customer' a letter polite, but brief, to-the-point and commercial showing:

    • What was the original agreement, including the scope of the intended use.
    • That it was not a work-for-hire and that, by the practice standard for the industry, you do not make the copyright to your original illustrations.
    • What it was that nothing stated in the original agreement while allowing a third party to create works derived from the original. (Understand, part of your "immaterial compensation" for a project like this is its presence in the main points of sale.) Substandard alteration by another person effectively reduced your compensation "agree to the '.)
    • If the 'client' now wants out of the agreement, you should be compensated for the work done so far. (Often previously stipulated and is called a cancellation fees, usually 50% of the originally agreed tax, but it may be something appropriate. Conditions of cancellation costs generally indicate that the Group of the cancellation does not rights on the work in progress).

    Personally, before or immediately after (depending on how damaged the relationship is already), I would consult my lawyer.     The lessons learned, this should include:

    • The need for a legal link in case you have this need. That is a cost not much. This does not mean that you must pay a charge regular withholding. Find a honest and trust lawyer interested in the treatment of such triviality for you on a basis as needed. Most of these problems are solved with a simple letter "we mean business". Understand, when it comes down to brass tacks, lawyers get an important part of the colony in the framework (if not all) of their fees. Get 2/3 of your scheduled payment is better than nothing, but it is best to avoid such difficulties with the routine and fair trade practices.
    • A basic element of the routine and fair commercial practices is the need for standard business forms. You should have at least a "one-size-fits-all" standard quote on what language simple and direct form sets general conditions about copyright law, cancellation, etc.. You may need several pieces of presentation "boilerplate" prepared in advance for several types of projects, you take several times. If you do not already have a solution, I would advise you to FileMaker Pro (it's affordable, powerful, easy to learn, use and customize the database program). You can use it to build your estimates, invoices, customer base and a lot of other things, including solutions for data-driven projects. FileMaker has become my favorite "graphic program."
    • Don't sign ANYTHING without an agreement.
    • NEVER tolerate non-payment.
    • Projects involving a lot of time may require an agreement with steps; non-refundable additional payments due to the completion of specific "milestones".

  • Adobe Stock marketing, support and practical cancellation unpleasant and misleading

    Practical marketing of Adobe Stock are misleading.  I participate in a class action against Adobe and contribute to the financing of the judicial proceedings against them.  They have the promo 'get 10 free images' misleading that they ran in all directions, and they have buried deep in the EULA cancellation fees.   They do cancel extremely difficult.  In addition, they summer hit my credit card for the fees, even if I cancelled and worked out much taxes as original as possible.   These deceptive marketing tactics are brutal and need to get more publicity.  Their wicked practices poison relations still further to the end user.

  • Best practices for starting new projects...

    Hope this does not seem too much question "nooob.

    I was editing a small project from a few months back and has problems with a lag, someone on here suggested, I give in and which would sort all late development issues and he has done much to my relief, I could edit in peace.

    What I want to ask is - are there any other good practice like that I could use to make my life easier...

    Or just basic things I should do before editin, base workflow...

    Just need a few thank you very basic pointers in advance.

    A few...

    (1) do NOT trust auto-enregistre to save your project... with one-s set for say 10 minutes/20saves, in a day's work on a sequence of a project of 4 sequence. The day following a different sequence of work, finding it had been corrupted somehow the day before... and find out ALL auto-enregistre them is recent enough that they are ALL corrupted even. Very bad... very bad.

    Make a backup - as increments from time to time and of course on another drive your standard project files to pass is not a bad idea, because you automatically have a backup system in the event of corruption or disk problems. Not perfect but you will survive.

    (2) Organization of assets is your friend! In came video stops, it is a VERY different beastie. With a structure of folders on your drives hard is wise, if you have a drawing and know where things are... more... learn how to use the thing 'locations', virtual folders and not things really moving on disk, but it can help to keep your projects feasible they get largest & most complex.

    I've seen diagrams for several different people and they were all different... ask about or look at Organization of video projects, organizing first pro online projects... you will get a lot of samples.

    (3) one word: AUDIO! Yet once, from stills I went immediately after learning to make things look pretty (involving a LOT of time learning SpeedGrade)... which is fine, really. I have spent so much time perfecting my audio capture & cleaning PrPro or hearing. I learned my choice muchly and I am now learning hearing. Audio cleanup is for most of the people most important to have the most beautiful images in your videos. Most I have eyeballs do not seem to be as critical as mine are... but surprisingly, the brand I ear is quite commonly used. Well...

    (4) know your Machine! Tools of the trade, including the basic courage of our computers, are very important. MANY posts here are dealing with questions from people not having not actually their rig set up right, including the people who put thousands of dollars/francs/that it is in their "beast"... but it is not really 'balanced' that advocates Page of the Tweaker (the bible to the PrPro/Ae hardware problems).

    Spending $ 2500 on a map of Quadro hot video because you get a little behind in reading will normally squat... because there is no that many 'effects' cards Quadro really help with first, second... that "dragging" is probably because of things like not enough disks to spread parts of the project to avoid read/write and crash that causes the ENTIRE process to wait for traffic to cross... not enough 'real' nuclei (i7 chips as) my studio platform to say that they have '8' hearts, but four are 'virtual'... ninou, he's only got 4 cores REAL), not enough RAM, too few/slow 'ways' or 'tracks' on the bus of the motherboard, not enough of space on one or more drives from spinning, so there is a hangup as things are cached on this drive for read/write... all sorts of things.

If the BOM contains information of Formulation, trade and specification of package of materials, how to define these facilities in trade and material package specifications?     I'll put up a small environment Vi3 with two HP DL380 G5 machines ESX and NFS on NetApp for storage. This must be installed in a field of laboratory and serve as both a learning platform Vi3, we, the admins and a test environment for some of our customers run their own virtual machines with the test software and others. For this purpose, safety is a higher priority than redundancy, roughly equal performance. What is a decent way to implement the two natachasery for this configuration?

    vSwitch1 and pNIC2:

    -VM network

    This would obviously no redundancy (not counting the vMotion between hosts) but separate VM and non - VM traffic. Is there anything else I should be concerned?

    Available seems very well, simply create a trade.

    (Depends on the load, you might want to consider making another Nic dual or quad). I have 2 natachasery for virtual machines and 2 for NFS...
