  How do you create the new layer? Looks like you have a selection and use ctrl/cmd-J. If you have a choice and it is empty, you will get this error.

  Windows xp does not support 3d and some of the new features that rely on the gpu.

  XP even if you have photoshop cs6 extended menu 3d still is not visible.
