  I got it to work!  I have put my phone into recovery mode and did a restore. Who did upgrade to iOS 9.2 and then I was able to restore from my backup iPhone 4S.

  To skip the activation of sim card, you can use iTunes if you have a CDMA iPhone. However, if you have a GSM model you will need to insert a sim card to activate your iPhone (it can even be used/inactive).
