My product key"is to upgrade only" so now I can't activate Windows 8 after spending $70

Two weeks I upgraded to Win8 of Win7. (PS my laptop is not originally mine so I do not have the Win7 drive). Last Sunday, Windows could not update and crashed my system. After trying in vain to get help from Microsoft (and accumulating of the phone bill), I changed my hard drive and freshly reinstalled Windows 8. Finally I was in business... only that now my product key will not work. She is a straight key, but after several hours (and a bigger to my phone bill) I said that my drive is "for the upgrade only' and cannot be used for a clean reinstall. What? 1. what happens if someone doesn't have a disc with another OS, as is the case with me? 2. why I didn't say me that when 'redeveloped '? 3. what happens if someone has hardware problems and is forced to reinstall their OS, as was the case with me?
