  Go to settings > general > storage & use iCloud > manage storage (the first) > and if there is an update, delete it. Then go to settings > general > Software Update and try again.

  If that doesn't work, try updating through iTunes on your computer.

  You need a sim card in the phone to activate or restore it... no way around that fact. So, beg, borrow, or buy a sim card if you want to activate the phone. You can remove the sim card when the phone is turned on.

  Backup to iCloud only works in Wi - Fi, you can not use a cellular network connection to backup your phone to iCloud.

  If the iCloud backup does not work, back up your phone to your computer using iTunes and set it back to factory settings, and then restore from that backup.
