  The pencil tool uses the outline color, the one on the left. Right click on this color indicator in the Properties window. The color picker should appear. In the top of the color selector part will be an indicator for the density of the selected color. Change that number to 100. Now you should be able to draw with the pencil tool, as you'd expect.

In CS5 I can select several paths and then, using the pencil tool, freely change paths without losing the multi-path selection. It is a great way to tweak a form of paint.
