Seagate hard drive is bad. warranty of 5 years, but seagate says I have to go through oem?

I have a Pavilion P6277C ({personal information deleted}) which was carried in the shop (aka my home: job from a friend/family). The user States chkdsk runs every time you start and takes 40 minutes to connect to windows if it opens a session.

    Borrow an OEM Windows CD (it must be OEM) and install it using your product key. (You can make a copy of it for your future use - this isn't the CD you pay because it's the product key).     You can not take a hard drive that was in another computer when the Windows installation, place it in another computer and boot from it. You will get a boot loop.     As much as I know RAM and HDD upgrade do not negate the warranty. For many models of laptops, you can find instruction how to do this. It is described in the document of the user s manual or you can find short videos on Toshiba documents (knowledge base).
