Portege M400 fan noise

I have a new Portege M400. The fan runs constantly even when the computer is started cold. The CPU is definitley do not run pretty hot the fan if necessary. None of the settings in the TOSHIBA Power Saver cause the fan turn off, even the setting of life. Is this a BIOS problem? Or a hardware failure? Or what?

    I have a M400 that runs on THIS 2.1, BIOS 2.1N, Windows 7, 32 bit, which is freshly installed and a T2400 processor and 2 GB of memory, I tested it recently and are OK. The computer sometimes suddenly stop just with BSOD 0 x 101 when I somple tasks like writing a note in OneNote or not scrolling through a Word Document - so no heavy CPU or made of special tasks. I know that the BIOS 2.1 is old but it is the newest one that is available with a noise of acceptable fan behavior - so I really don't want to upgrade the BIOS.

    So, I worked on a few possible reasons for this STOP error:

    -Defective CPU
    -bad driver who is initially a lock
    -Bug of the BIOS

    So my questions are:

    is there somewhere out there who had this problem too?
    Can someone tell me if this is perhaps a known error fixed in a newer BIOS?

    Did anyone out there to have a newer BIOS with the behavior of low fan noise? (I doubt it)
    Toshiba cannot simply change a newer version of the BIOS with the fan thing? I just don't understand how you can throw a laptop on the market that has a fan which is still running at least at medium speeds even though the is completely WITHOUT CHARGE and the CPU is at 30 ° C.
